New Strategy Unveiled for $166 Billion in Tariff Refunds

A system designed to handle a minimum of $166 billion in tariff refunds may be operational within 45 days. A senior US Customs and Border Protection executive stated, “That’s the alternative to a manual process that could take 4 million hours.” However, it remains uncertain when the over 330,000 US importers who paid the levies under President Donald Trump’s assertive trade agenda will receive those funds. Last month, the Supreme Court invalidated the majority of the extensive global tariffs implemented by Trump. In a court filing on Friday, Brandon Lord stated that the agency is “making all possible efforts” to implement a new automated process that will require “minimal submission from importers” within 45 days. The updates are essential to handle the “unprecedented volume of refunds” that CBP was mandated to process by a Court of International Trade judge this week.

Nintendo, Costco, FedEx, and thousands of other businesses have initiated legal action against the government seeking tariff refunds; however, it appears that such measures may no longer be required. Under the new system, importers would submit declarations detailing all instances in which they paid the now-invalidated duties, Lord stated. The government would confirm that information to determine the possible refund for importers. “CBP will provide guidance on how to file to refund declarations in the new system,” Lord stated. “This looks to be a very positive development for importers,” stated Matt McGill. In the 13-page court filing on Friday, Lord refrained from providing any estimates regarding when importers might expect to receive refunds on tariff payments, should they adhere to the procedures he outlined.

Before Friday’s filing, the Trump administration had not provided specifics on how it would handle these refunds. It is often stated that it would defer to the lower courts, as the Supreme Court verdict did not provide any guidance on the issue. In the wake of the ruling, Trump expressed to reporters his belief that the matter would require litigation “for the next two years” and suggested that it might take five years for refunds to be processed.
